FCCPC Summons Air Peace Over Failure to Refund Cancelled Flight Tickets

The Federal Competition and Consumer Protection Commission (FCCPC) has formally summoned Air Peace for allegedly failing to refund passengers for cancelled flights—a move the Commission says violates consumer protection laws.

In a statement released on Monday by Mr. Ondaje Ijagwu, Director of Corporate Affairs at the FCCPC, the Commission stated that the airline’s failure to issue timely refunds may have breached Sections 130(1)(a), 130(1)(b), and 130(2)(b) of the FCCPA 2018.

> “Consumers are entitled to prompt refunds when services—such as flight bookings—are not fulfilled,” the statement emphasized.

Summons and Required Documentation

The Commission’s formal summons, dated June 13, 2025, directs Air Peace to appear at the FCCPC headquarters in Abuja on June 23, 2025. The notice was issued under Sections 32 and 33 of the FCCPA, which provide the legal basis for such action.

> “Section 33(3) mandates compliance. Failure to do so may result in heavy penalties, including fines or imprisonment,” Ijagwu noted.

Air Peace is also required to submit detailed records, including:

A log of customer complaints regarding refunds over the past 12 months

Records of all processed refunds

A list of all cancelled flights across its routes within the same period

Remedial measures taken to alleviate passenger hardships

Ongoing Investigations into Ticket Pricing

Ijagwu also disclosed that in 2024, the FCCPC began a separate investigation into alleged exploitative ticket pricing practices by Air Peace, including sharp price hikes for advance bookings on certain domestic routes.

However, Air Peace responded by filing a lawsuit in an attempt to stop the Commission from proceeding with that investigation.

“It’s important to note that the current summons is separate from the ongoing inquiry into pricing practices,” the FCCPC clarified.
